CONSTITUTION AND

BY-LAWS OF SSG
AND
SSG OFFICERS
OF
POLYTECHNIC COLLEGE OF
DAVAO DEL SUR
PREAMBLE
• We, the students of Polytechnic College of Davao del Sur , with
the help of divine providence , and believing in the need for a
better organized council and in the development of the youth as
a future leaders of the nation , desiring to form a united student
organization that shall embody the ideals and principle of
democracy and the promotion of the welfare of all students and
the academic standards of our school, do hereby promulgate
and adopt this Constitution and By-Laws that shall advance,
implement and maintain our goals and aspiration.
ARTICLE I. GENERAL PROVISIONS
• SECTION 1. This Constitution and By-Laws shall be known as the
Constitution and By-Laws of the Supreme Government of the Polytechnic
Collage of Davao del Sur.

• SECTION 2. The name of this organization shall be the Supreme Student


Government of Polytechnic Collage of Davao del Sur.

• SECTION 3. For purposes of this Constitution and By-Laws, SSG refers to


the Supreme Student Government and PCDS refers to the Polytechnic
Collage of Davao del Sur.

• SECTION 4. The Office of the SSG shall be located inside PDCS campus and
in a place most accessible to the students.
ARTICLE II. DECLARATION OF
PRINCIPLES AND OBJECTIVES
• SECTION 1. The SSG of PCDS shall promote mutual understanding through
social, Civil, intellectual, recreation and scientific program and activities.

• SECTION 2. The SSG shall have the following objectives:


– a. Develop love of God and country, moral character, personal discipline leadership and
efficiency among members.
– b. Trains its member foe effective and efficient leadership
– c. Help students develop Self-Confidence.
– d . Maintain school’s aspiration to promote quality education.
– e. Serve and protect the students rights and welfare.
– f. Represent the students in the policy-making body of the school.
ARTICLE III.
MEMBERSHIP

• All officially enrolled students of PCDS are members or


the student to whom the SSG shall be accountable at all
times.
ARTICLE IV. RIGHT OF THE STEDENTS
MEMEBERS
• SECTION 1. Every student have the right to enjoy responsible freedom of speech and
expression .
• SECTION 2. Every students have the right to avail of the services offered by the SSG.
• SECTION 3. Every students have the right to information on all issues and matter
concerning them.
• SECTION 4. Every students have the right to conduct and participate in all school’s
activities.
• SECTION 5. Every students have the right to vote, to be nominated and be elected
into office.
• SECTION 6. Every students have the right to be presented in the different meetings
and Assemblies of the school on issues affecting the welfare of the
students.
• SECTION 7. Every students has the right to attend SSG meetings.
• SECTION 8. Every students have the right to due process.
ARTICLE V DUTIES, RESPONSIBILTIES AND OBLIGATION
OF STUDENTS MEMBERS

• SECTION 1. Every students member has the responsibility to


observe at all times, the laws of the Republic of the
Philippines, ans the rules and regulation of PCDS.
• SECTION 2. Every student member must pay on time all SSG
fees as approved by the Department of Education, TESDA
and CHED issuance or by the school’s proper authorities,
• SECTION 3. Every students member must support and promote the
thrust and objectives of SSG and PCDS.
• SECTION 4. Every student member must abide by the SSG
Contittution and By-Laws.
• SECTION 5. Every member must participate in all school.
ARTICLE VI POWERS AND DUTIES OF THE SUPREME STUDENT
GOVERNMENT

• SECTION 1. The SSG shall be the highest governing


body of the entire students.
• SECTION 2. The SSG shall have the following powers
and duties.
– A. formulate and recommend programs that will address
relevant issues and concerns of the students.
– B. plan and iplement policies and programs designed to
promotes students' right and welfare.
– C. serve as representative as student in voicing their
opions, suggestions and grievances.
– D. spearhead drug abuse and youth smoking
prevention programs in the school.
– E. act as faciliatators and assistance during school
ointramurals and other school activities.
– F. Submit financial statements and accomplishments
to the school authorities and cause the Publication of
the same.
– G. turn over papers and documents, properties and
other responsibilities to the incominf SSG officers.
ARTICLE VII . COMPOSITION, ELECTION,
QUALIFICATION AND TERMS OF OFFICE OF THE SSG
• SECTION 1. The following are the electve sofficers of the SSG
– a. President
– b. Vice- President
– c. Five Senators
– d. Two Representatives for every department; and
– e. A Governor for every department

The president, vice-president and senators shall be elected by direct


vote of the whole students of PCDS. The governors and Representative
shall be elected by direct vote of the sudents belonging to their respective
departments.
• SECTION 2. The secretary, Tresurer and Auditor of the SSG shall
compose the Cabinet Memebers of the President. They
shall appointed by the president from among the
students and shall be confirmed by the majority vote
of all the elective officers. cabinet may express their ideas
and suggestions during SSG meetigs but shall have no
right to vote.
• SECTION 3. ALL SSG shall be conducted school-wide annually
every third or last week of february
• SECTION 4. Campaign period of all SSG elections shall not be
more than ten (10) school days prior to the election day
SECTION 5. Candidates for all SSG Positions shall have the
following qualifications;
– a. bonifide students
– b.of good moral character and have not been subjected o any disciplinary
sanctions;
– c. A student of PCDS for at least (1) one year or (2) two consecutives semester
prior to the filling of the certificate of candidacy.
– d. of average academic standing without any failing grade during the current
semester;
– e. enrolled for at least fifteen units for the first and second semester in the next
school year of which he shall hold office.

SECTION 6. The term of office all SSG shall be one school year
which will began in the first day and in the last day of school.
ARTICLE VIII DUTIES AND FUNCTIONS OF SSG OFFICERS

• SECTION 1. THE PRESIDENT shall be the cheif executive of the


SSG. He shall have ithe following duties:

– a. preside overall meeting and/ or may designed another officer to


preside for a promulagted.
– b. enforce the constitution and by-laws and other regulations that
may be promulgated.
– c. sign all official minutes, resolution, correspondences, and other
official papers of the SSG.
– d. represent the SSG or designate his respresentative for any external
or internal affair functions.
– e. implement SSG programs and projects
– f. perform such other functions inherit abd incidental to his office.
• SECTION 2. The vice-president. The vice president shall
have the following duties:

– a. assist the president in all the matters where his assistance is


necessary
– b. assume the office of the president if the position should
become vacant
– c. supervise members in planning and arranging meetings or
programs of activities
– d. erform such other duties assigned by the SSG.
• SECTION 3. The senators and representatives. The
senators and representatives shall have the following
duties.
– a. Create ordinance, resolution, policies and regulations that
would improve the welfare of the students.
– b. Prepare budget proposal for any activities that the SSG
may undertakes.
– c. Perform such other duties inherit and incidental to their
office.
• SECTION 4. The governor. The governor sall be the cheif
Executive of his department. he sahll have the
following duties.

– a. exercise general supervision and control overall program,


projects and activities of the department.
– b. assist the president in enforcing the costitution and by-
laws and other regulations promulgated by the SSG to his
department.
– c. peform such other duties by the SSG.
• SECTION 5
• A. The secretary. he scretary shall have the following
functions:
– 1. Keep accure record of the minutes and document
proceedings of every SSG meeting.
– 2. Keep a file of all the pertinent documents and papers of the
SSG and made them accessible of the students
– 3. Call and prepare all notices of meetings.
– 4. Perform such oher duties assigned by the president.
• B. The treasurer. The treasurer shall have the following
functions:

– 1. keep al financial records of the SSG


– 2. serve as the disbursing officers of all the SSG Funds.
– 3.prepare financial reports after an activity, nd at the end of
semester.
– 4. perform such other duties assigned by the SSG
• C. The Auditor. The auditor shall have the following
functions.

– 1. Certify the legitimacy and correctness of the disbursement


of the funds
– 2. Audit all expenditures of the SSG funds.
– 3. Keep and update inventory of all the SSG properties
– 4. Perform such other duties assigned by the SSG.
ARTICLE IX THE SSG ADVISER
• SECTION 1. The SSG adviser must be a full time
instructor of the PCDS.
• SECTION 2. He must have been teaching in PCDS for at
least two (2) consecutive school years.
• SECTION 3. The SSG dviser shall monitor all programs,
project, activities and meetings of the SSG at all
times.
ARTICLE X THE COMMISSION ON
ELECTIONS
• SECTION 1. The commission on election, herein referred to as the SSG
COMELEC, Shall be established within 15days before the day of the election.

• SECTION 2. THE SSG COMELEC shall be the only agnecy taht will
manage the electoral process, including the campaign.

• SECTION 3. the SSG COMELEC shall be composed of ten (10) members or


two (2) representatives for each department, who do not vested interest in
the election, or any way related to any of the candidates. they shall
thereafter select a chairman from among themselves.
• SECTION 4. the members of the SSG COMELEC shall be appointed by the director of
the Students Affairs after consulting the different department heads.

• SECTION 5. THE SSG COMELEC shall have the following duties and responsibilities:
– a. conduct fair, honest and systematic election
– b.validate the electoral proceedings an results
– c. accept or provoke candidacy
– d. proclaim the winners of the elections
– e. keep all the pertinent election papers/documenst
– f. devides upon the protest rlstive to the conduct and results of the elections
– g. prepares and distribute the necessary election paraphernalia, certificate of
candidacy, forms an other election related materials beofer during and after the
aleacton.
– h. disqualified candidates who hacve violated any of the guidelines which have
been promulgated, and
– i. perform each other functions incidental to its office.
ARTICLE XI THE SSG FUNDS
• SECTION 1. The SSG funds shall be classified into trust fund and
special funds. the trust fund shall consist of the school
oragnization fee, the amount which shall be decided upon by
the school administration in consultation and with the approval
of the students. the special funds are the funds that come from
donations, sponsorship, fund raising projects or any amount
derived from the legitimate sources.

• SECTION 2. The SSG can undertake fund raising


activities to subsidize its project and activities.
SECTION 3 the SSG accepts donatIon from any member or any
public or private institution for as long as it will not affect the
intergrity of the SSG
SECTION 4 The SSG President and the treasurer shall be the
signatory of all fund disbursment of the SSG. All fund
disbursement mst be accompanied with an SSG resolution duly
noted by SSG Adviser.
SECTION 5 The funds of the SSG shall be audited at the end of
the semester or at the end of every acivity
ARTICLE XII MEETING AND QUORUM
• SECTION1 . The SSG conduct regular meetings every first sunday
of the month or as Agreed upon by the officers of the SSG.
• SECTION2. Speciak meetings of the SSG may be caled upon the
President or by a majority of the SSG oficers.
• SECTION 3. Majority of the officers of the SSG (50%) shall
constitute the quorum
• SRCTION 4. Each elective officers of the SSG is entitled to only
one vote.
• SECTION 5. No Proxy shall be allowed when voting.
ARTICLE XIII IMPEACHMENT,
RESIGNATION, VAGANCIES
• SECTION1. the officers of the SSG may be impeached on
the following grounds.
– a. Culpable violation of the constitution and By-Laws
– b. Gross misconduct, voilence to the person in authority,
negligence and disloyalty to the cause of the SSG and the
PCDS
– c. Non-attendance in regular meetings for three (3)
consecutive times; and
– d. abuse or misuse of power and authority.
• SECTION2. Two/thirds (2/3) votes of the officer shall
be necessary to decide after hearing a case of
impeachment.
• SECTION3. The decision of the SSG officer shall be
final. howerver, the offices charged shall be informed
ten (10) days prior to his impeachment case
proceedings, of the charge/charged against him, to
afford the opporunity to be heard.
• SECTION4. Resignation of any SSG officer shall be in
writing and subject to the approval of the majority vote
of all the elective SSG Officers.
• SECTION5. any vacancy of the position of theSSG for the
reason of death, resignation and impeachment, shall be
filled in a manner to be dicided by the SSG.
• SECTION6.Any vacancy of the ssg position shall be filled
within thirty (30) days from the day the position is
vacated. the officer eleceted to fill the vacancy shall
serve teh remaining period.
ARTICLE XIV AMENDMENTS OR
REVISIONS
• SECTION1. Any amendments t, or reviesion of this
constitution and by-laws may be proposed by any SSG
officers upon a concurrnece of a threee-fourths vote of
all the other SSG officers.
• SECTION2. the contitutd by-laws maybe amended or
revised in full or in part only once every five (5) years
from its adaptation by the students.
• SECTION3. Any amendment to, or revision of this
constitution shall be valid when retifies by a majority of
the votes cast in a plebiscite which shall be held out
earlier than thirty (30) days nor later tha,
• forty-five (45) days after the approval of such
amendmet or revision.
• the foregoing proposed constitutions and by-laws of the
supreme studet govenrment of polytechnic college of
Davao del Sur was approved by a the SSG officers of the
school year 2018-2019 on the first day of August two
thousand eighteen accordingly signed on that same day
at polytechnic College of Davao delSur by said officers
whose signatures are hereunder affixed.
