DEFINITION OF CONTRACTOR
IN BUILDING CONSTRUCTION
According to R.A. No. 4566,
 CONTRACTOR is deemed synonymous with the term
“builder” and, hence, any person undertakes or offers to
undertake or submits a bid to, or does himself or by or
through others, construct, alter, repair, add to, subtract from,
improve move, wreck, or demolish any building, highway,
road, railroad, excavation, or other structure, project,
development or improvement, including the erection of
scaffolding or structures of works in connection therewith.

managing the subcontractors, consultants and
vendors, and involving them throughout the project,
start to finish, from design through construction.

CONTRACTOR's LICENSE LAW

Republic Act No. 4566, otherwise known as the


“Contractor' s License Law”,

as amended by P.D. No. 1746 provides that no


contractor (including sub-contractor and specialty
contractor) shall engage in the business of
contracting without first having a PCAB license to
conduct business.

 The PCAB performs regulatory and quasijudicial
functions, and is tasked with the registration and
licensing of contractors intending to engage in the
consruction.
PURPOSE OF CONTRACTOR'S LICENSE LAW

• It is to ensure for the safety of the public, that only


qualified and reliable contractor's are allowed to
undertake construction in the country.
• The law also aims to promote for the benefit of the
public and private sectors and for the national
interest, the orderly growth of the contracting sector
and the upgrading of construction.
TYPES OF CONTRACTOR'S LICENSE
REGULAR LICENSE
authorises the licensee to engage in construction
contracting within the scope and field of its license
classification for as long as the license is valid
(renewed annually, and not suspended, cancelled
or revoked.
reserved for domestic construction firms that are at
least 60% owned by Filipinos.
TYPES

SPECIAL LICENSE
issued to a joint venture, consortium, foreign
contractor or a project owner, authorising the
licensee to engage in the construction of a single
specific undertaking or project.

EXAMINATION REQUIRED.
In accordance with the rules and regualtions
promulgated by it, the Board may investigate,
classify and qualify applicants for contractors'
licenses by written or oral examination, or both.

QUALIFICATIONS OF APPLICANTS
To show at least two years of experience in the
construction industry, and knowledge of the building,
safety, health and lien laws of the Republic of the
Philippines and the rudimentary administrative principles
of the contracting business.

 In a partnership, corporation, or any other
organization may qualify through its responsible
managing officer who shall prove that he is a bona
fide responsible officer of such firm and that he
exercises or is in a position to exercise authority
over the contracting business of his principal or
employer in the following manner:
(1) to make technical and administrative
decisions; and, (2) to hire, superintend, promote,
transfer, lay off, discipline or discharge employees.

AMO SEMINAR
The AMO seminar is a two(2)-days seminar that is
intended to equip the contractor/applicant with the basic
knowledge on construction safety, building and lien laws,
taxation, labor and other relevant laws, and the basic
principle of the construction business.

ISSUANCE OF LICENSES
Upon payment of the corresponding fee and the filing of
the application, and after examination and investigation as
maybe required, the Board within fifteen days after the
approval of the application shall issue a license to
applicant permitting him to engage in business as a
contractor under the terms of this Act for the remning part
of the fiscal year.
FEES

a) Fifty pesos for an original license;


b) Sixty pesos for examination of an applicant;
c) Fifty pesos for an annual renewal.
VALIDITY OF A CONTRACTOR'S LICENSE

 A regular license shall be valid for one (1) fiscal year,


from the 1st of July to the 30th of June of the ensuing
year unless suspended, invalidated, cancelled, or revoked
by the board and shall be renewed annually.

 A special license shall be cancelled by the Board


upon completion of the single specific
undertaking/project authorized by the license and to
which it is, therefore, restricted even though before the
expiry of the fiscal year.
