Applicability of Law
 Supplements the Comprehensive
Agrarian Reform Law

 Applies
to Private Agricultural Lands
devoted to rice and corn under share
tenancy or lease-tenancy
Transfer of lands to Tenants
PD. No. 27 provides that:
“The tenant farmer, whether in land estate or
not, shall be deemed owner of”
EO No .228 further provides that:
“Section 1. All qualified farmer beneficiaries are now
deemed full owner as of October 21, 1972 of the land
they acquired under P.D. No. 27)

Conditions:
- Does not mean automatic transfer of title or
ownership
- There has to be a full payment of just compensation
Size of the land to be
transferred
 Tenant-farmer is entitled to:
a) Five (5) Hectares, If not irrigated
b) Three (3) Hectares, if irrigated

Note: Landowner can retain not more than


seven (7) hectares if he is cultivating it or will
cultivate it
Stages of land transfer
a) Issuance of Certificate of Land Transfer
(CLT) to the beneficiary
b) Issuance of Emancipation Patent (EP)
Significance of the CLT
• Does not vest ownership of the land
• Qualifies the tenant-beneficiary to possess
the land and comply with certain
conditions preparatory to ownership
• If complied with conditions, he is issued an
Emancipation Patent
Significance of EP
 Vests upon the farmer-beneficiary
absolute ownership over the landholding
 Constitutes conclusive authority for the
issuance of an original or transfer
certificate of title in his name
Indefeasibility of EP
 Same indefeasibility and security as
Torrens Title
 Emancipation patent becomes
indefeasible and imprescriptible after one
(1) year from its registration – Registry of
Deeds
Cancellation of EP
 Emancipation Patents may be cancelled on
the following grounds:
a) Abandonment of the land
b) Neglect or misuse of land
c) Failure to pay three (3) annual amortization
d) Misuse or diversion of financial support services
e) Sale, transfer or conveyance of the right to use
the land
f) Illegal conversion of the land
