Final Testing and Sealing Before Election
Day
• APRIL 29, 2016 – Not later than this date, the BEI will be notified of
the date, time, and place of the testing and sealing
of the VCM.
• May 2-6, 2016 - Within this period, the BEI shall convene in its
assigned polling place to test and seal the VCM
assigned to its precinct.

Powers and Functions of the BEI
Conduct the voting and counting of votes in their
respective polling place, including the Final Testing and
Sealing (FTS) of the Vote Counting Machine (VCMs)

Act as deputies of the Commission in the supervision


and control of the election in the polling places
wherein they are assigned, to assure the holding of
the same, in free, orderly and honest manner.

DUTIES OF THE BEI
• Meet at the polling place not later than 5:00 a.m. on 09 May
2016
• Ensure that the VCM box and the ballot box are inside the
polling place
• Set-up the polling place
• Post one (1) copy of the PCVL of each precinct in the
cluster, near or at the door of the polling place
 Show to the watchers and the public present that the:
 VCM box is sealed
 Ballot box is empty, thereafer lock with 4 seals
 Package of official ballots is duly sealed, thereafter break the seal
VOTING PRIVILEGE OF THE MEMBERS OF THE BEIs

The Chairperson and members of the Board of Election


Inspectors MAY vote in the polling place where they are
assigned on election day if they are registered voters of
the city, municipality or district where they are assigned.
(Sec. 9 of Reso. No. 10031).

In the alternative, the BEI may avail of LOCAL ABSENTEE


VOTING (Reso. No. 10003).

MEETING OF THE BEIs
• It shall be public and held only in the polling place
• Decide by majority vote
• Have full authority to maintain order within the polling place
• May issue a WRITTEN ORDER directing any peace officer or any
person deputized by the BEI to take any person who refuses to obey
or conduct himself in an disorderly manner that disrupts the
proceedings into custody until the adjournment of the meeting.
• BUT THE ORDER SHOULD NOT PREVENT THE PERSON FROM VOTING
• The copy of the ORDER shall be attached to the Minutes
Attendance of the Members of the BEI
• TEMPORARY VACANCY IN THE BEI
• The Members present shall call upon the substitute of the absent member to perform
the duties;
• If none, Members present may temporarily fill the vacancy by appointing any qualified
non-partisan registered voter of the precinct until the absent member appears or the
vacancy is filled
• ARREST OF THE MEMBER
• The Member/s may ORDER THE ARREST of any member or substitute who has
absented himself with the INTENTION OF OBSTRUCTING the duties of the BEI.
• RELIEF and SUBSTITUTION of the MEMBERS OF THE BEI
• The members of the Board of Election Inspectors shall not be relieved unless
disqualified by COMELEC Resolutions or any existing law.
PRELIMINARIES TO VOTING
Preliminaries to the voting. –
The BEI shall: 5:00

1) VCM box is sealed;
2) Ballot box is empty and thereafter, locked
with four (4) plastic seals;
3) Package of official ballots is duly sealed, and
thereafter, break the seal.

PRELIMINARIES TO VOTING
f) For precinct/clustered precinct with detainee voters
(DV) and with established special polling places for
DVs, the BEI of the said regular polling places shall,
using the EDCVL-DV:
1) Annotate the DVs’ names in the EDCVL with “DV”;
2) Affix his initial beside the annotation;
3) Enter in the Minutes the number of DV and the
fact that their names were annotated with “DV”;
4) In the presence of the SBEI-DV support staff,
segregate the ballots intended for the DV, and
insert the same in a folder;

5) Place the folder inside an envelope, close the
envelope and seal the envelope using a paper
seal. The envelope and paper seal shall be
provided by the SBEI-DV support staff
6) Affix their initials on the paper seal; and
7) Turn over the envelope containing the DV ballots
to the SBEI-DV support staff, as the case may be
NOTE: EXPLAIN TO THE WATCHERS THE
PRESENCE OF THE SBEI-DV SUPPORT STAFF AND
INFORM THEM THAT THE BALLOTS WILL BE
USED BY THE DETAINEE VOTERS AND WILL BE
RETURNED TO THE CLUSTERED PRECINCT
BEFORE 5PM TO BE SCANNED BY THE VCM.

WATCHERS

Each INDEPENDENT CANDIDATE or REGISTERED


POLITICAL PARTY is entitled to
• TWO (2) WATCHERS who shall SERVE ALTERNATELY in every polling
place.
QUALIFICATIONS OF WATCHERS

1. REGISTERED VOTER of the city or


municipality where he is assigned.
2. Of GOOD MORAL CHARACTER.
3. Has not been CONVICTED BY FINAL
JUDGMENT of any election offense or
any crime.
• Knows how to READ and WRITE
Filipino, English or a local dialect.
• Not related within FOURTH CIVIL
DEGREE OF CONSANGUINITY OR
AFFINITY to the BEIs in the polling
place where he seeks appointment as
watcher.

Additional Qualifications for Grupo
Progreso/NPC Watchers:

1. Must be loyal to the Grupo Progreso;


2. Must belong to the clustered precinct where
he/she is assigned;
3. Physically fit, alert and sensible;
4. Well-disciplined and follows instructions
faithfully.
DUTIES OF WATCHERS

1. MUST BE AT THE CLUSTERED PRECINCT BEFORE IT OPENS.


2. Present their appointments to BEI chairman upon entering the
polling place.
 The chairman shall RECORD the names in the minutes with a
notation under their signatures that watcher is not
disqualified.

3. Not to speak to the BEI or a voter, or among themselves, which


will disrupt the proceedings of the BEI.

4. IF AVAILABLE, affix their signatures and thumb marks in the ERs,


in the case of watchers representing:
 Dominant majority party
 Dominant minority party

IMPORTANT REMINDERS TO ALL OF OUR POLITICAL

2. You MUST ALREADY know your clustered precinct and
sequence number BEFORE going to the polling places.
3. You MUST HAVE your own copy (kodigo) of the names
and numbers of our candidates.
4. You MUST see to it that your hands are CLEAN and free
from used oil or any substance that may smudge and

Upon receipt of challenge, BEI shall require challenged voter


to present proof of:
•Registration
•Identity
•Qualification

BEI SHALL IDENTIFY the voter in the EDCVL, through


his/her:

CHALLENGE BASED ON CERTAIN ILLEGAL
ACTS
A VOTER or WATCHER may challenge any person
offering to vote on the ground that he:
1. Received or expects to receive, paid, offered
or promised to pay, contributed, offered or
promised to CONTRIBUTE MONEY or ANYTHING
OF VALUE as consideration for his vote or for
the vote of another; or
2. Made or received a promise to
INFLUENCE THE GIVING OR WITHHOLDING
of any such vote; or
3. Made a BET or is interested directly or
indirectly in a bet that depends upon the
results of the election.

5. ERASE any printing from the ballot ,or PUT any
distinguishing mark thereon.
6. USE Capturing Devices, including, but not limited to, digital
se cameras or cellular phones for whatever purpod

PREPARATION OF BALLOTS FOR ILLITERATE AND
PERSON WITH DISABILITY

Assistance in the Preparation of Ballot

A voter is not allowed to vote as illiterate or


PWD UNLESS SUCH FACT IS INDICATED in the
EDCVL.

The ASSISTOR shall prepare the ballot in the


presence of the illiterate or PWD.

The assistor shall bind himself in writing and


under oath to FILL THE BALLOT STRICTLY in
accordance with the instructions of the voter
and NOT TO REVEAL THE CONTENTS thereof, by
affixing the signature in the appropriate space
in the MINUTES. 63

PREPARATION OF BALLOTS FOR ILLITERATE AND
PERSON WITH DISABILITY

Assistance in Using the VCM

A person who is PHYSICALLY IMPAIRED may, upon his request,


be assisted in feeding his ballot into the VCM by the BEI
member or support staff, who shall ensure that the contents of
the ballot are NOT DISPLAYED DURING THE FEEDING of the
same into the VCM. (NOTE: This fact should be recorded in the
MINUTES.)

PREPARATION OF BALLOTS FOR ILLITERATE AND
PERSON WITH DISABILITY

In ALL cases, the poll clerk shall:

First VERIFY from the illiterate or PWD whether he


had authorized the assistor to help him to cast his
vote

The Assistor can ONLY ASSIST THREE (3) Illiterate or


PWD voters, except the member of the BEI.

Assistor must be of voting age and:


a relative within the FOURTH CIVIL DEGREE of
consanguinity or affinity;
any PERSON OF HIS CONFIDENCE who belongs to
the same household; or
a MEMBER of the BEI. 65

ACCESSIBILE POLLING PLACE TO PWD AND
SENIOR CITIZENS
All clustered precincts with accessible precincts shall be
located at the ground floor, preferably near the entrance of
the building, and is free of any physical barriers and
provided with necessary services, including assistive
devices. THE BEI SHALL SET UP A SEPARATE AREA IN SAID
POLLING PLACE FOR THE EXCLUSIVE USE OF THE PWDs and
SCs. For this purpose, the Election Officer shall coordinate
with the proper school or building officials.

EXPRESS LANE FOR PWD, SC, HEAVILY PREGNANT WOMEN, ESCORDED
DETAINEE AND IP

Be afforded an EXPRESS LANE and be allowed to vote as soon as


they arrive.
SIGN shall be posted inside the polling place indicating the
location of the express lane and who can avail of it.

PREMATURE ANNOUNCEMENT OF VOTING
During voting, no member of the BEI shall
make ANY ANNOUCEMENT as to:
Whether a certain registered voter has
already voted or not
As to how many have already voted

the state of the polls
Any statement at any time, except as
witness before a court or body as to how
many persons voted

HOLDING AREA

The BEI in coordination with the Supervisor, SHALL designate a


room to be used as holding area.
To be used by voters waiting for their turn to vote.
Voters shall sit and arrange themselves on a FIRST COME, FIRST
SERVED basis.

DETERMINE THEIR SEQUENCE OF VOTING IS

6. If fingernail not stained, establish identity of voter
through:
i. photograph or specimen signature in EDCVL
or any other ID;
ii. In the absence of proof of identity, a
MEMBER OF THE BEI or a REGISTERED VOTER of the
precinct/clustered precinct may identify under oath
a voter, and such act shall be reflected in the
Minutes.
•If satisfied with his identity, the name of the voter
shall be DISTINCTLY ANNOUNCED in a tone loud
enough to be heard throughout the polling place.
•OTHERWISE, the voter shall be directed to LEAVE
the polling place after informing him the reason
thereof.

PROCEDURE:
9. If the voter is not challenged, or having been challenged, the
QUESTION HAS BEEN DECIDED IN HIS FAVOR, the voter shall be
required to sign the EDCVL and be directed to the chairman of the BEI.
In case of illiterate voters or PWD who cannot sign, require said voters
to affix their thumbmarks in the EDCVL.
10. The Chairman shall:
i. AUTHENTICATE THE BALLOT BY AFFIXING HIS SIGNATURE at the
designated space at the front thereof.
The failure to authenticate a ballot shall NOT INVALIDATE THE BALLOT
but shall constitute an ELECTION OFFENSE.
ii. Show to voter that ballot being given is not torn or smudged, and has
not yet been filled up;

iii. Place

designated voting area

ONLY THE CHAIRMAN shall issue the

MANNER OF VOTING
VOTING shall be conducted in the following
manner:

1. The voter shall FILL HIS BALLOT BY FULLY


SHADING THE CIRCLE besides the names of the
candidates of his choice, using the secrecy folder
and marking pen.

2. The voter shall then APPROACH THE VCM,


INSERT HIS BALLOT in the ballot entry slot, after
which the voter SHALL RETURN the ballot
secrecy folder and marking pen to the third
member.

PRINTING OF RECEIPT ( VOTERS )
VOTER’S RECEIPT
• The BEI shall ensure that ONLY THE VOTER
CAN READ THE RECEIPT.
• Bringing the Receipt OUTSIDE the polling
place is ILLEGAL.
• Any person who takes away the VOTER’S
RECEIPT commits an ELECTION OFFENSE and
is punishable by One Year Imprisonment.
MANNER OF VOTING

3. The poll clerk/support staff shall MONITOR, from


afar, the VCM screen to make sure that the ballot was
successfully accepted and the receipt is printed.

4. Fold the receipt in such a way that its contents


cannot be seen and then cut the end of the receipt using
non-pointed scissors.

A. Receive from SBEI-DV support staff accomplished ballots

clustered precincts have finished voting;
E. Feed the ballots to the VCM;

WAS MISREAD. PLEASE VERIFY BALLOT AND REFEED.
 Let the voter RE-FEED the ballot in four (4) DIFFERENT
ORIENTATIONS.

2.PREVIOUSLY READ BALLOT


-The VCM shall display the messages "THE BALLOT PREVIOUSLY
SCANNED /ANG BALOTANG ITO AY NABASA NA" and "THIS
BALLOT HAS BEEN PREVIOUSLY SCANNED".
> The options “TO RETURN THE BALLOT” and “DIVERT BALLOT”
will be displayed.

3. INVALID BALLOT
- When a ballot that is not configured to the VCM is fed, it will
display the messages "INVALID BALLOT DETECTED/ MALING

- The ballot belongs to another precinct.

- Voters shall return the ballot to chairman who shall VERIFY if

shall:
>Mark the ballots as “REJECTED”
>Chairman shall then ISSUE CORRECT BALLOT to voter.

NEXT PRECINT belonging to the same councilor district, where
he shall cast his vote.

C/MBOC shall verify from the BEI concerned the reason for
the non-transmittal of the results.

3. Even if not all of the expected results have been received


but said results will no longer affect the result of the election
in a particular position, a majority of the members of the BOC
should accede to lower the threshold to proclaim a candidate
and should seek approval thereof from the appropriate
authority but in no circumstance can it be lowered further than
90%. (Sec. 11 (IV) , COMELEC Resolution No. 10083)
