Cartelisation is a formal agreement among firms in an
industry. Cartel members may agree on such matters as
prices, total industry output, market shares, allocation of
customers, allocation of territories, bid-rigging,
establishment of common sales agencies, and the division
of profits or combination of these

 THE CARTEL WAS AT ITS PEAK IN EFFECTIVENESS IN 1994, WHEN THE PRICE OF LYSINE
REACHED ABOUT US $ 1.20 PER POUND. THIS PRICE WAS APPROXIMATELY US $ 0.50 ABOVE
THE COMPETITIVE PRICE LEVEL. IN THE FIRST 3 MONTHS OF THE CONSPIRACY, PRICES WENT
UP ABOUT 70% IN A MARKET WITH ROUGHLY US$ 500 MILLION IN ANNUAL SALES
WORLDWIDE

 THE OVERCHARGE TO US CUSTOMERS DURING THE CONSPIRACY PERIOD AT US $ 141


MILLION.

 A PROJECTION OF THE GLOBAL OVERCHARGE BY LYSINE CARTEL IS US $ 200-250 MILLION.


THE PRICE INCREASE RESULTED IN DECLINE IN PURCHASES AND CONSEQUENTLY IN
DECLINE IN PRODUCTION DEPENDENT ON LYSINE.

 THE CARTEL HAD THE EFFECT OF BENEFITING THE CARTEL MEMBERS BECAUSE OF THE
HIGHER SALE PRICES BUT AT THE COST OF DEVELOPING COUNTRIES’ COMPETITORS. ONLY
AFTER THE CARTEL BROKE UP, NEW ENTRANTS HAVE TAKEN TO PRODUCTION OF LYSINE.
 VITAMINS CONSTITUTE AN IMPORTANT INGREDIENT
SUPPLIED TO THE FOOD PROCESSING INDUSTRY AND THE
ANIMAL FEED INDUSTRY.

 FOOD COMPANIES BLEND RAW VITAMINS INTO BREAD, RICE


AND JUICE. THE ANIMAL FOOD INDUSTRY BUYS BULK
VITAMINS TO PRODUCE HEALTHIER AND FASTER GROWING
LIVESTOCK. AN EXAMPLE WOULD BE HUGE CHICKEN FARMS.

 PRODUCERS OF VITAMINS FORMED A CARTEL DIVIDING UP


THE WORLD MARKET FOR DIFFERENT TYPES OF VITAMINS

US $ 25 MILLION. 10 EUROPEAN COUNTRIES SUFFERED AN
OVERCHARGE OF ABOUT US$ 660 MILLION. ALL THE 90 IMPORTING
COUNTRIES PUT TOGETHER SUFFERED OVERCHARGES BY US $ 2700
MILLION DURING THE 90S

THE POOR COUNTRIES DIRECTLY OR INDIRECTLY BEAR THE COST


OF THIS UNLAWFUL PRACTICE IN TERMS OF HIGHER PRICES AND
REDUCED CHOICE.
 THE ANTI-COMPETITIVE STRUCTURE OF THE TOBACCO MARKET.

 BIG BUYERS FORMED A CARTEL. THEY WERE FOUND TO INDULGE IN


AUCTION RIGGING. ACCORDING TO A REPORT ON TOBACCO
SALES IN MALAWI COMPILED BY CLIVE STANBROOK, A RENOWNED
BRITISH LAWYER, "ONE OF THE REASONS THAT THE CONTRACT
SALES FOR FLUE CURED TOBACCO WERE AT BETTER PRICES THAN
ON THE AUCTION FLOOR … MAY HAVE BEEN BECAUSE THEY WERE
CARRIED OUT IN LESS TRANSPARENT CIRCUMSTANCES".

 TWO BIG PLAYERS IN THE TOBACCO MARKET DIMON AND


STANDARD COMMERCIAL MERGED THEIR WORLDWIDE
OPERATIONS AND INDULGED IN CARTELISATION PRACTICES THUS
RESULTING IN MANY SMALL AND MEDIUM BUYERS LEAVING THE
AUCTION FLOOR. THUS THE EXISTING TWO MAIN BUYERS WERE
ABLE TO EXCLUDE OTHER BUYERS FROM THE MARKET BOTH BY
THEIR STRONG MARKET SHARES AND MAKING MARKET ACCESS
ALMOST IMPOSSIBLE FOR NEW ENTRANTS.

 CARTELISATION THUS AFFECTED ADVERSELY THE INTEREST OF


TOBACCO BUYERS.
 Cement prices have been increased four times since
January this year.
 The Builders Association of India has said that
cartelization by cement manufacturers is the root
cause for the frequent price hikes.
 Jet Airways and Kingfisher Airlines -
announced that they will be synergizing
their operations to tide over the difficult
times facing the Indian aviation space.
 UNPRECEDENTED RISE of food prices across Asian countries
 There were thoughts of creating a cartel of Organisation of
Rice Exporting Country (OREC) same on the line of
Organisation of Petroleum Exporting Countries (OPEC).
 The frustration of Asian countries is justified as despite
accounting for more than 60% to 70 % of world rice
production
 Formation of cartel of rice exporting countries will help the
member countries to earn more foreign exchange, as cartel
will be able to keep the prices at high level. Good foreign
exchange earnings from rice export will improve the
economic status of these countries, as capital formation in
agriculture will increase in these countries.
 Thailand and Vietnam itself produce half of the rice of world.
 America has seldom bothered of oil price inflation of world,
as it is able to produce more than 40 per cent of its domestic
oil requirement. But the oil reserves data of world shows that
by 2012 US oil reserve field of United States of America
(USA) may dry and hence the activities of ethanol production
by diverting corn and soybean has picked up in USA.
 As one can stop driving his car for months if price of oil
crosses US dollar 200.00 ,but it will be very difficult to
survive few days without having staple food like rice or
wheat. Even all junk foods are having a mix of these rice or
wheat in one form or the other.
 cartelisation in rice will benefit only few and will trouble
entire world.
Cartels are considered the most pernicious of
anti-competitive practices. In many
jurisdictions cartelisation or collusion is
treated as a criminal activity under the law.
While companies have paid heavy fines,
senior executives have even undergone jail
sentences. Besides, cartels don’t only relate to
price fixing but also division of business,
territory, restriction on output, etc. They can
create barriers to new entrants and non
members to the cartel agreement.
