NAB PRESENTATION

The National Accountability Bureau (NAB) was established


under the National Accountability Ordinance (NAO) 1999.
Being Pakistan's apex anti-corruption organization NAB has
been mandated with the responsibility of elimination of
corruption through a holistic approach of Awareness,
Prevention and Enforcement. It covers the whole of Pakistan
including areas which are part of Federal and Provincial
Administered Tribal Areas. It takes cognizance of all offences
falling within the NAO against holders of public office and
other persons.

Vision: National Accountability Bureau aims to be a credible, effective,
efficient and dynamic anticorruption organization creating an enabling
environment for a corruption free society by engaging all stakeholders in the
fight against corruption through a program which is holistic, inclusive and
progressive.
Mission: To eliminate corruption through a comprehensive approach
encompassing enforcement, prosecution, awareness and prevention.
Mandate: To take cognizance of acts constituting offences of corruption
and corrupt practices, eradication of corruption and corrupt practices and
hold accountable accused persons and matters ancillary thereto.
Objectives: Short Term: Setting in motion systemic improvements that
will strengthen the national integrity system and the people against
corruption. Long Term: The elimination of corruption by engaging all the
stakeholders in the fight against corruption, through a programme, which is
holistic, comprehensive and progressive

Awareness: Awareness is aimed at correcting ill habits of Society through
education and character building so as to build public opinion and a will to
eradicate corruption and corrupt practices. The new anti corruption realization
will be owned by all sectors of society. Under the mandate given under section
33 C (a) (b) of NAO 1999, NAB is conducting following activities for awareness
against corruption:
• TV Talk Shows
• Radio Programs
• Walks
• Lectures
• Seminars
• Workshops
• Advertisements in leading English / Urdu newspapers.
• Newsletters
• Essay Writing Competitions
• Declamation Contests
• Poster / Painting Competitions

• Character Building of future generation through establishment of
Character Building Societies (CBS) at schools, colleges and universities
level, across the country.
• Publication of procedure for lodging a complaint in NAB on the Bill Board.
• Installation of permanent bill boards carrying anti corruption slogans at
prominent points.
• Printing NAB’s message on Utility Bills.
• Dissemination of anti-corruption messages through mobile phone
messaging in addition to electronic media.
• Holding of seminars in a year for different segments of societies, with
active participation of NGOs and UN offices to ensure greater visibility and
effectiveness.
• In commemoration of Anti Corruption Day (9th December), holding of
different activities i.e. TV Talk Shows, seminars, walks, declamation
contests, display of posters / Banners and publication of Special
Supplements in the
newspapers.

Prevention: The prevention operations involve examination of the system
and procedures of administration and stopping the corruption from
happening through a mechanism of timely intervention.
i) Project Evaluation Under the provisions of Section 33-B the NAB has
been entrusted with the responsibility to evaluate contracts worth
Rs.50 Million or more. Under Pre-Procurement Regime, NAB has to
intervene promptly in the area of ‘about to happen’. The pre tendering
procurement processes are to be made rule compliant for fair play and
transparency.
ii) Prevention Committees (33C of NAO)
Under the mandate of Section 33C, prevention committees are
constituted for reformation in the regulatory mechanism. The mandate
is to look into the rules and regulations of Provincial as well as Federal
departments and suggest doable recommendations in coordination
with the concerned department.

Enforcement: The operational procedures of NAB have been evolved with
a view to lay down unambiguous criteria for an objective and transparent
assessment of cases. The operational procedures comprise following stages:
Receipt of complaints: Section 18 of the NAO stipulates that NAB can take
cognizance on receipt of a complaint from the appropriate government
department or agency, member of the public or on its own accord.
Preliminary examination / probe (Complaint Verification):
The complaint is examined by relevant experts in order to determine the
nature of the offence and the possibility of taking cognizance under the
NAO.
Combined Investigation Team (CIT): To inquire / investigate the cases of
corruption, judiciously and transparently, the concept of Combined
Investigation Team (CIT) is implied and enforced in NAB.

Inquiry: During this stage, formal evidence is collected according to law to
determine whether there is sufficient evidence to incriminate the accused. If
accused is a government servant, concerned department is informed.
Accused is offered the option of Voluntary Return (VR) at this stage.
Investigation: Investigation is advanced stage, which is authorized after
scrutiny of evidence and discussion with experts (financial as well as legal).
The investigator collects evidence and prepares report according to the law.
The investigation process entails interviewing of accused, recording of
witness statements, collection and examination of evidentiary material. The
option of Plea Bargain (PB) is available to the accused at this stage.
Arrest of accused: Section 24 of NAO empowers Chairman NAB to issue
Warrant of Arrest of accused. In order to execute arrest following tools are
also adopted:
• Placement on Exit Control List (ECL)
• Issuing of Red Notice
• Extradition through INTERPOL

Priority of cognizance of cases: Cases are prioritized by
adopting a priority matrix. Priority is assigned on the basis of
gravity of offence, the profile of accused and amount of
corruption money involved.
Decision making process: In the course of enforcement
operations and legal proceedings, the prime decisions of
authorization/closure of inquiry/ investigation, accepting /
rejection of PB/VR application and reference filing are being
taken in the Executive Board, chaired by Chairman NAB or
Regional Board chaired by DG Region.
ECL: At any stage of the case, name of an accused is placed on
ECL through Ministry of Interior on request of NAB.
Freezing of assets: Sec 12 of NAO empowers NAB and Court
to freeze property, assets and bank accounts of the accused
person.

Prosecution: Prosecution is one of the most vital and integral Division along
with Operation Division (Ops Div) that operate like two wheels of chariot
under NAO, 1999 for logical conclusion of cases. After thorough investigation
of the cases by the Ops Div, the baton is passed to Prosecution for legal vetting
of investigation report and filing of Reference in the Accountability Court
subject to prior approval of the Chairman NAB.
To ensure transparency and neutrality of the investigation of cases and filing of
references, an independent office of Prosecutor General Accountability (PGA)
has been established within NAB under section 8 of NAO, 1999. The President
of Pakistan, in consultation with
the Chairman, may appoint any person, who is qualified to be appointed as a
Judge of the Supreme Court, as PGA. The PGA shall hold independent office on
whole time basis and shall not hold any other office concurrently. The PGA
shall hold office for a non-extendable period of three years. The PGA shall not
be removed from office except on the grounds of removal of a Judge of Supreme
Court of Pakistan. The PGA shall give advice to the Chairman upon such legal
matters and perform such other duties of a legal character as may be referred
or assigned to him by the Chairman and in the performance of his duties.

COUNTRY REVIEW
Under United Nations Convention against Corruption (UNCAC)
Pakistan and Qatar are involved in Country Review of
Kazakistan. Similarly Pakistan and Indonesia are involved in
Country Review of Kyrgystan. These Country Review Reports are
under process in UNODC Secretariat Vienna, Austria. Country
Review of Pakistan has been conducted by Norway and Solomon
Island. The report is also under process in UNODC Secretariat
Vienna.

Overview
During the year 2015 the Bureau’s agenda was focused on fighting
corruption in all its manifestations through implementation of its
three pronged strategy i.e. Enforcement, Prosecution, Awareness and
Prevention. To succeed in attainment of the strategy. NAB employees
led by its Chairman, worked hard and were able to achieve good
results.
During the year 2015 a total of 30004 complaints including the backlog
of 8x complaints as compared to 18818 in 2014 were received. All the
30004 complaints were processed and not a single complaint remained
under process by closing of the year. Similarly in 2015 845 inquiries
were authorized as compared to 887 inquiries in 2014 on investigation
side 452 investigation were authorized in 2015 as compared to 226
investigation in 2014. In the year 2015, 293 References have were filed
while 733 References are under process.

PILDAT and Transparency International Reports
Pakistan is improving its position amongst the International community, in
terms of corruption. As per Transparency International (Berlin) Report on
Corruption Perception Index (CPI) for the year 2014 Pakistan got the best
position ever since the first CPI was publicized in 1995. Evidently, Pakistan
secured 29 points out of 100 and stood at 126th position out of 193 countries, as
compared to the preceding year i.e. 2013, when it got 28 points and standing at
127th position. Pakistan again improved its position as per Transparency
International Report on corruption perception index (CPI) for the year 2015
from 126 to 117 which further boosts the dedication of NAB toward eradication
of corruption from the Country.

PILDAT survey has placed NAB as the most trustworthy of Government


Departments. As many as 42% of Pakistanis have shown their trust and
confidence in NAB as compare to 30% for Police and 29% of other Government
Office and other Departments.
