Analysis
What is a crime?
• Crimes invove two elements:
• -the physical act of doing wrong
(=Wrongful Act or Actus Reus)
• The intention of wanting to do something
wrong.(wrongful intention or Mens Rea)
Actus Reus
• Actus Reus is not only the wrongful act but
also
• Posession of something deemed to be
illegal or illegally obtained and
• Omission when there is a duty to act but
no action is taken.
When there is a charge
• There must be proof • But there is also the
beyond a reasonable right to seek a
doubt to link the defense based on
accused directly to certain criteria.

What is the effect of the defense?
• Any reasonable defense can result in two
outcomes:
• A: the accusation can not be reasonably
maintained as there is enough doubt in
either one or both of the charged elements
of the offense;
• B: the defense results in a lesser charge
as there may be sufficient extenuating
circumstances.
