Retirement
 (1). Retirement means stopping of work after
attaining a particular age limit or retiring from
employment of a worker on completion of
certain age.
 Retirement is of following types:
Normal retirement - completion of 59 years of
employee’s age.
Optional retirement (Voluntary retirement) – completion
of 25 years of employment in any establishment.
Forced retirement

Hours of work
 (4). Hours of work: Working hour means the
time when the worker remains under the
control of his employer for work excepting
time for eating and resting. Or Hours of work
means the time during which the workers
employed are at the disposal of the employer
excluding any interval allowed for rest and
meals.
Factory
 (7). Factory: Factory means such premises or
yard where generally five or more workers
remain engaged in work on any day of the
year. Or Factory means any premises
including the precincts thereof, whereon
ordinarily five or more workers work on any
day of the year and in any part of which a
manufacturing process is being carried on
but does not include a mine.
Adolescent
 (8). Adolescent: Adolescent means a person
who has completed his fourteenth years but
has not completed eighteenth years of age.
Gratuity
 (10). Gratuity: Gratuity means wages payable on
termination of employment of a worker which
shall be equivalent to not less than 30 (thirty)
days wages at the rate of last drawn wages for a
full year or more than 6 (Six) months service
which he gets on conclusion of service, or in
case the of more than part thereof in excess of
6 (Six) months, or in case of more than 10 (Ten)
years’ service which shall be equivalent to not
less than 45 (Forty Five) day’s wages of
concerned worker at his last payment rate.
Retrenchment
 (11). Retrenchment: Retrenchment means the
termination by the employer of services of
worker on the ground of needlessness caused
by redundancy.
Termination
 Termination of employment refers to the end
of an employee's contract with a company. An
employee may be terminated from a job of
his/her own free will or following a decision
made by the employer.
 Termination of employment can be done both

side i.e. either employer or employee by


providing with 3 month’s basic pay or 3
months’ notice in writing.
Trade Union
 (15). Trade Union: Trade union means trade
union of workers or employers formed and
registered under chapter XIII of this act and
shall include a federation of trade unions.
Discharge from service
 (17). Discharge from service: Discharge
means the termination of services of a worker
by the employer for reasons of physical or
mental incapacity or continued ill-health
certified by a registered medical
practitioner/officer.
Go-slow
 (18). Go-slow: Go-slow means an organized,
deliberate and purposeful slowing down of
normal output of work by a body of workers
in a concerted manner, and which is not due
to any mechanical defect, breakdown of
machinery, failure or defect in power supply
or in the supply of normal materials and
spare parts of machinery.
Day
 (19). Day: Day means a period of 24 hours
beginning at 6.00am.
Strike
 (22). Strike: Strike means a cessation of work
by a body of persons employed in any
establishment acting in combination or a
concerted refusal, or refusal under a common
understanding or any number of persons who
are or have been so employed to continue to
work or to accept employment.
Shift
 (29). Shift: Shift means, where work of the
same kind is carried out by two or more sets
of workers working during different periods
of the day, each of such period.
Maternity Benefit
 (34). Maternity Benefit: Maternity Benefit
means, the sum of money payable under the
provisional of chapter IV to a woman worker
with leave.
Adult
 (36). Adult: Adult means a person who has
completed eighteenth year of age.
Dismissal
 (39). Dismissal: Dismissal means termination
of service of a worker by the employer for
misconduct/serious offence.
Illegal Strike & Illegal lock-out
 (43). Illegal Strike: Illegal Strike means a
strike declared, commenced or continued
without any notice.

 (44). Illegal lock-out: Illegal lock-out means a


lock-out declared, commenced or continued
without any notice.
Wages
(45). Wages means all remuneration, expressed in terms of money
or capable of being so expressed, which would, if the terms of
employment, expressed or implied, were fulfilled, be payable to a
worker in respect of his employment or of work done in such
employment, and includes any other additional remuneration of
the nature aforesaid which would be so payable, but does not
include the following money, namely:
 (a) The value of any house accommodation, light, water, medical
facilities or other amenity or the value of any service excluded by
general or special order by the Government;
 (b) Any subscription paid by the employer to any pension fund or
provident fund;
 (c) Any travelling allowance or the value of any travelling concession;
 (d) Any sum paid to a worker to defray special expenses entitled to
him by the nature of his employment.
Collective Bargaining Agent (CBA)
 52. Collective Bargaining Agent (CBA): means
any such trade union or trade union
federation of any establishment or group of
establishment, which works as the agent of
the workers in the matter of Collective
Bargaining.
Lock-out
 (57). Lock-out: Lock-out means the closing of
a place of employment or part of such place, or
the suspension, wholly or partly, of work by an
employer, or refusal, absolute or conditional,
by an employer to continue to employ any
number of workers employed by him, where
such closing, suspension or refusal occurs in
connection with an industrial dispute or is
intended for the purpose of compelling
workers employed to accept certain terms and
conditions of or affecting employment.
Lay-off
 (58). Lay-off: Lay-off means the failure,
refusal or inability of an employer on account
of shortage of coal, power or raw material or
the accumulation of stock or the break-down
of machinery, to give employment to a
worker.
Industrial Dispute
 (62). Industrial Dispute: Industrial Dispute
means any dispute or difference between
employers and employers or between
employers and workers or between workers
and workers which is connected with the
employment or non-employment or the term
of employment or the conditions of work of
any person.
Child
 (63). Child: Child means a person who has
not completed his fourteenth year of age.
Week
 (66). Week: Week means a period of seven
days beginning at 6.00pm on Friday or such
other night as may be fixed by the
governance in relation to an establishment in
any area.
