A court is a form of tribunal, often a governmental institution, with the authority to adjudicate legal disputes between parties and carry out the administration of justice in civil, criminal, and administrative matters in accordance with the rule of law. In both common law and civil law legal systems, courts are the central means for dispute resolution, and it is generally understood that all persons have an ability to bring their claims before a court. Similarly, the rights of [ 2 those accused of a crime include the right to present a defense ] before a court. [1]

Court The laws and jurisdictions in the United Aram Emirates is highly influenced Systems in by the French, Roman, Egyptian and Islamic laws. Some law principles like UAE adopting previous court judgments as legal precedents are not recognized.
Only local firms might appear in front of a court. As the UAE has made itself as regional hub for international businesses, negotiations became an important method for resolving conflicts and disagrees.

Court Structure The Abu Dhabi Supreme Court is the federal and highest court in the UAE,
however Dubai and Ras Al-Khaima are subjected to it and are not part of the federal judicial system. But instead they have their own court systems. There are three main branches within the court system in general: civil, criminal and Islamic laws. Also the court structure includes Court of First Instance, Court of Appeal and Court of Cassation.

The Civil Court

Or sometimes it is called The Court of First Instance hears all claims and takes all charges ranging form commercial matters to maritime conflicts. When a judgment has been made, the charged have the right to appear before The Court of Appeal on factual and legal grounds within a month of the date of the judgment. Also it is possible to deliver additional evidences and witnesses and then be called to testify. Just to notice, each emirate has its own court of first instance. 4/29/12

Afterwards the charged may appeal on pints of law alone to the Court of Cassation, which consists of five judges. That appeal must be filled in one month from the day of the judgment. All decisions and judgments of this court are final and cannot be altered.

criminals begin with the filing of a protest with the local police force where the felony was committed. Throughout the investigations the police may take the statements of anyone involved. After this initial investigation local police refer the case to the prosecutors office in less than two days. Also the police may refer to the prosecutor to ask for advice before initiating the official 4/29/12

Following these actions, the prosecutors office will then investigate in the case further, take statements from anyone involved hear from any witnesses. After that the prosecutor will decide either to refer the case to the court or decline any charges duo to insufficient evidences. However the prosecutor must make a decision within two weeks from the day of receiving the matter from the police. But if the prosecutor needs more time to come to decision, he can request for extension with the court, which is approved or denied at courts discretion.

Sharia Islamic What work alongside the civil and criminal courts are the Islamic courts. court
These courts are responsible for dealing and resolving issues between Muslims. Also they have the exclusivity of hearing family conflicts, like divorce, inheritance, child custody, child abuse and guardianship of minors. When any provision in the UAE codified law is absent, the Islamic Principles of Sharia are applied.

In addition to that the Sharia Courts have the rights to hear form certain cases including rape, robbery, drunk driving and such. Which originally these crimes are tried to lower courts.

The Court of It is the highest court in the UAE and it Cassation


will only hear disputes on matter of law. It will only take actions as an appellate court while respecting and taking decisions from lower courts in consideration. However it will supervise and monitor all lower courts to ensure they act under the law correctly.

Dubai and Ras Al-Khaima have their own Court of Cassation. So unlike the other emirates the, final appeals and cases do not report to the Supreme Court located in Abu Dhabi. 4/29/12
