Act to provide for the constitution of a body at the national level for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities To handle theire related issues

Chapter 1
extends to the whole of India expect of J&Kashmir Definitions: Autism: Condition of uneven skill development
Affects communication & social abilities Repetitive & ritual behavior

Cerebral Palsy:
Non-progressive condition Abnormal motor control Brain insult or injuries Pre-natal, peri-natal or infant period of development

Mental Retardation:
Arrested or incomplete development of mind Sub normality of intelligence

Multiple Disabilities: Combination of two or more disabilities Severe Disability: 80 % or more of one or more of multiple disabilities

Professional: special expertise in the field of disability

Chapter 2
Board: Superintendence, direction & management of the TRUST
CONSTITUTION OF BOARD
A CHAIRPERSON 9 MEMBERS - 3 each from voluntary organization, association of persons with autism..associations of persons with disability, 8 PERSONS FROM MINISTRIES & DEPARTMENTS 3 PERSONS FROM INDUSTRY CHIEF EXECUTIVE OFFICER 3 Years Term

Chapter 3
OBJECTIVES EMPOWER INDIVIDUAL TO LIVE CLOSE TO COMMUNITY STRENGTHEN FACILITIES FOR PERSONS TO LIVE IN FAMILY SUPPORT ORGANIZATIONS PROVIDING SERVICES DURING CRISIS

SUPPORT PERSONS NOT HAVING FAMILY CARE OF PERSONS ON DEATH OF PARENTS APPOINTMENT OF GUARDIANS FOR PERSONS REQUIRING PROTECTION EQUAL OPPORTUNITIES, PROTECTION OF RIGHTS AND FULL PARTICIPATION

Chapter 4
POWER & DUTIES OF BOARD RECEIVE CONTRIBUTION OF 100 Corers FROM CENTRAL GOVT BEQUEST OF MOVABLE PROPERTY FOR FROM ANY PERSON FOR OBJECTS ANY FURTHER SUPPORT FROM GOVT

APPROVED PROGRAMME
INDEPENDENT LIVING IN COMMUNITY Conducive Environment Counseling & Training of Family Adult Training Centre Individual & Group Homes Self Help Groups Local Committees for Guardianship

Respite Care Foster Family Care Day Care Services Residential Homes Residential Hostels (preference given to woman with disability / to persons with severe disability /senior citizen with disability )

CHAPTER 5
Any association of person with disability / any association of parents of persons with disability/ voluntary organization whose main object is promotion of welfare of persons with disability may make an application APPLICATION IN PRESCRIBED FORMAT ENQUIRY AS PER GUIDELINES RECOGNITION GRANTED or REJECTED

Chapter 6
Local level Committees 1. CONSIST OF: GOVT REPRESEENTATIVE AT LEAST DISTRICT MAGISTRATE PERSON FROM REGD. ORGANIZATION A PERSON WITH DISABILITY 2. TENURE: 3 Years 3. Meeting: Once in 3 Months 4. Function: Appointment of Guardian

GUARDIAN
1. Application to LOCAL AUTHORITY by: Parent or relative of a PWD Registered Organization 2. LOCAL AUTHORITY to consider: Whether person needs a GUARDIAN Purpose for which guardianship required 3. Application forwarded to BOARD 4. Guardian to furnish inventory and accounts 5. REMOVAL of Guardian: Abusing or neglecting the person Misappropriating or neglecting property

Chapter 7
Accountability and Monitoring documents of Board shall be open to inspection Board will have annual general meeting for evaluation

Chapter 8 Finance, Accounts and Audit


Board shall prepare, in time in each financial year budget for the next financial year showing the estimated receipt and expenditure of the Trust and shall forward to the Central Government accounts of the Trust shall be audited by Auditor General of India/ behalf of him / related auditor

Chapter 9 Miscellaneous
GOVERNMENT CONTROL BOARD Bound by DIRECTIONS of Govt. Decision of Govt. FINAL POWER of Govt. to Supersede BOARD EXEMPTION from tax on INCOME

Protection of action of Members taken in good faith Chairperson, Members and Officers of BOARD to be PUBLIC SERVANTS
