You are a member of the German parliament, the Bundestag. As deep fakes have become a
more and more contentious issue, you are now debating whether they should be forbidden
and criminalized. This would mean that creating a deep fake of someone would be
considered a breach of their personality rights, punishable by a fine or even prison time.

Give your opinion on whether deep fakes should be criminalized.

This could happen to you. Like millions of people worldwide, you have uploaded digital
photographs of yourself to the internet through social media platforms. Your pictures
aren’t sexually explicit or revealing—they depict your daily life, spending time with
friends or taking “selfies” on vacation. But then someone decides they don’t like you.
Using an app available on any smartphone, this antagonist clips digital images of your
face from your innocuous pictures and pastes them seamlessly onto the body of a person
engaged in sexually explicit acts. Without your knowledge or consent, you become the
“star” of a realistic, pornographic deepfake.

§ 22 Kunsturhebergesetz („Recht am eigenen Bild“)

„Bildnisse dü rfen nur mit Einwilligung des Abgebildeten verbreitet oder ö ffentlich zur
Schau gestellt werden. Die Einwilligung gilt im Zweifel als erteilt, wenn der Abgebildete
dafü r, dass er sich abbilden ließ, eine Entlohnung erhielt. Nach dem Tode des
Abgebildeten bedarf es bis zum Ablaufe von zehn Jahren der Einwilligung der
Angehö rigen des Abgebildeten. Angehö rige im Sinne dieses Gesetzes sind der
ü berlebende Ehegatte oder Lebenspartner und die Kinder des Abgebildeten und, wenn
weder ein Ehegatte oder Lebenspartner noch Kinder vorhanden sind, die Eltern des
Abgebildeten.“
