Viele
hinterlftete
Fassaden
erfordern
ein
Unterkonstruktionssystem mit horizontalen L-Profilen,
befestigt auf Distanzhaltern mit einer Ausladung
entsprechend der Dicke der Wrmedmmplatten.
Zustzlich erforderliche Vertikalprofile zur Befestigung der
Bekleidungselemente werden nachtrglich zwngungsfrei
an den L-Profilen montiert (Gleitpunktreihen). Das
gesamte Fassadengewicht einer Geschohhe wird
von einer einzigen Fixpunktreihe getragen, an welcher
die Vertikalprofile unverschieblich fixiert werden. Die
Distanzhalter der Fixpunktreihe mssen hohe statische
Tragfhigkeiten aufweisen. FIX in a FOX realisiert diese
Anforderung auch bei hohen Auskragungen.
FIX in a FOX ist ein statisch hoch tragfhiger Distanzhalter fr
Fixpunktreihen horizontaler Unterkonstruktionssysteme.
Die hohe Tragfhigkeit wird durch die zweiteilige
Ausfhrung mit formschlssiger Verbindung erreicht.
Daraus resultierend entsteht eine kleine Anzahl von
Distanzhaltern pro Flcheneinheit (m2) und es knnen
krzere Montagezeiten mit geringerem Materialeinsatz
realisiert werden. FIX in a FOX Distanzhalter werden
gemeinsam mit einem verliersicher aufgeklipsten
Kunststoffisolator mit geringer Wrmeleitfhigkeit
ausgeliefert und damit auch hchsten bauphysikalischen
Anforderungen gerecht.
FIX in a FOX Distanzhalter aus Aluminium EN AW-6063
T66 werden stranggepresst mit Auskragungen bis zu
280mm hergestellt.
FIX in a FOX horizontal fixing
Many ventilated facades require a substructure consisting
of horizontal L-profiles fixed on brackets with an outreach
according to the thickness of the isolation.
Additional required vertical profiles for the fastening of
the cladding will be fixed subsequently free of restraint flexible point array.
The complete weight of the cladding for a height between
floors will be carried by one fix point array on which the
vertical profiles will be fixed.
The brackets of this fix point array need to exhibit heavy
static loads.
FIX in a FOX can achieve these requirements even for major
outreaches.
FIX in a FOX is a statically high resistant bracket for fix point
arrays using a horizontal fixing system. This high statically
resistance will be reached by a 2 part construction with a
positive connection. For that reason the number of brackets
will decrease per unit of area (m2), a short assembly time
with low material inventory will be another benefit of this
system.
To meet the building physic requirements the FIX in a FOX
bracket will be delivered with a pre-fixed isolator which
features a low thermal conductivity.
FIX in a FOX brackets are produced extruded in EN AW
6063 T66 quality. The outreach can be up to 280 mm.

MacFox - Vertikalmontage
Viele Bekleidungselemente hinterlfteter Fassaden
werden auf vertikalen Tragprofilen befestigt, welche mit
L-frmigen Distanzhaltern verschraubt werden. Jedes
Vertikalprofil mit Lnge einer Geschohhe wird an einem
Fixpunkt unverschieblich und an mehreren Gleitpunkten
verschieblich befestigt, um eine zwngungsfreie
Ausdehnung der Profile zu gewhrleisten. Fixpunkte
werden durch die Befestigung der Vertikalprofile in
den Rundlchern der MacFox Distanzhalter realisiert
(biegesteife Verbindung). Fixpunkte knnen damit sowohl
vertikale Gewichtskrfte als auch horizontale Windlasten
aufnehmen. Gleitpunkte entstehen durch Befestigung
der Vertikalprofile in den Langlchern der MacFox
Distanzhalter. Gleitpunkte knnen daher ausschlielich
horizontale
Windlasten
aufnehmen. Thermische
Dehnungen der Profile in vertikaler Richtung knnen
aufgrund der zwngungsfreien Montage unbehindert
erfolgen.
MacFox ist der ideale Distanzhalter fr den Einsatz bei
vertikalen Unterkonstruktionssystemen. Die erhhte
Tragfhigkeit fr den Fixpunkt wird durch die Ausfhrung
der Elemente mit 160 mm Hhe (Large) und Befestigung mit
zwei Dbeln gewhrleistet, fr die Gleitpunkte kommen
meist Elemente mit 80 mm (Medium) und einem Dbel
zum Einsatz. MacFox Distanzhalter werden gemeinsam
mit einem verliersicher aufgeklipsten Kunststoffisolator
mit geringer Wrmeleitfhigkeit ausgeliefert und damit
auch hchsten bauphysikalischen Anforderungen gerecht.

MacFOX vertical fixing

Each vertical profile with a height between floors will be
fixed on a fix point and re locatable on flexible points to
realise the expansion free of restraint.
Fix points will be realised by fixing the vertical profile in the
round holes of the bracket (bending resistant connection).
These brackets can carry vertical loads as well as horizontal
wind loads. Flexible points will be realised by fixing the
vertical profile in the elongated holes of the bracket. These
brackets can just carry horizontal wind loads. Because
of the free of restraint fixing, thermal expansions of the
profiles can be unhindered in vertical direction. MacFOX
brackets are ideal for vertical substructure systems. The
high bearing capacity of the fix point elements will be
warranted by using MacFOX brackets with a height of 160
mm (MacFOX Large) and 2 dowels for fixing them on the
background. Flexible points will be realised in most of the
cases by using a MacFOX bracket with a height of 80 mm
(MacFOX Medium) and just 1 dowel for fixing them to the
background.

Lieferungen und Leistungen erbringen wir, auch in Zukunft, ausschlielich auf Grund unserer nachstehenden
Geschfts- und Lieferbedingungen:
Abweichungen hievon gelten nur, soweit diese ausdrcklich schriftlich vereinbart sind. Entgegenstehende
Geschftsbedingungen des Bestellers gelten selbst dann nicht als vereinbart, wenn auf sie in Bestellungen
oder sonstiger Korrespondenz verwiesen wird, ohne dass es im Einzelfall eines ausdrcklichen Widerspruchs
unsererseits bedarf.
1. VERTRAGSVERHLTNIS
Angaben in Angeboten, Preislisten, Katalogen, Anzeigen, Werbeunterlagen und Ansichts- oder
Auswahlsendungen sind stets freibleibend und unverbindlich. Ein Vertragsverhltnis kommt erst mit
unserer schriftlichen Auftragsbesttigung zustande. Stillschweigen gilt nicht als Einverstndnis. Allfllige
Abweichungen unserer Auftragsbesttigung von der Bestellung sind bei sonstigem Ausschluss unverzglich
schriftlich zu rgen. Nach vorhergehender schriftlicher Vereinbarung knnen Bestellungen von Stammkunden
von uns auch mndlich/telefonisch besttigt werden.
2. PREISE
Es gelten ausschlielich die in unserer Auftragsbesttigung angegebenen Preise. Mndlich erteilte/
besttigte Bestellungen gelten als zu unseren am Bestelltag geltenden Listenpreisen aufgegeben. Skonti
auf Listenpreise werden von uns immer nur unter der ausdrcklichen Bedingung der vollstndigen und
fristgerechten Bezahlung aller Rechnungen gewhrt. Smtliche Preisangaben verstehen sich immer zuzglich
der gesetzlichen Umsatzsteuer.
3. LIEFERUNG
Sofern nichts anderes vereinbart ist, gilt Lieferungen ex Werk. Das Abladen erfolgt immer auf Rechnung und
Gefahr des Kufers. Wir sind berechtigt, Teillieferungen auszufhren. Wir sind bemht, die von uns bekannt
gegebenen Liefertermine nach Mglichkeit einzuhalten. Im brigen aber sind unsere Liefertermine, auch
wenn diese von uns besttigt wurden, ohne Gewhr. Liefererschwerungen durch von uns nicht zu vertretende
Umstnde, einschlielich etwaiger Lieferverzgerungen auf Seiten unserer Lieferanten, berechtigen uns
zur Verlngerung der Lieferzeit oder zum Rcktritt vom Vertrag. Ersatzansprche des Bestellers wegen
verspteter oder unterbliebener Lieferung sind in jedem Fall ausgeschlossen.
EUROFOX keinerlei berprfung, ob Ihre Angaben richtig sind. Wir bernehmen daher keine
Haftung fr die von Ihnen an EUROFOX gemachten Angaben. In diesem Zusammenhang sind daher
Gewhrleistungs- und Schadenersatzansprche Ihrerseits von vorneherein ausgeschlossen. EUROFOX
haftet nicht fr Qualittsmngel und unrichtige technische Angaben von Materiallieferanten. Fr Fehler
aus der Nichtbeachtung unserer Montageplne (Montagerichtlinien und technische Informationen) und
allgemein im Handwerk blichen Usancen bernehmen wir keine Gewhr. Wir gewhrleisten die Qualitt der
Produkte im Rahmen der in den Lieferprogrammen angegebenen Werte und Prfnormen. Die Eignung fr
bestimmte Anwendungen wird generell nicht zugesagt. Wir haften ausdrcklich nicht fr Mngel der Be- bzw.
Verarbeitung, der Unterkonstruktion oder der Montage sowie fr Schden infolge unrichtiger Verarbeitung
der Ware. Fr Fremderzeugnisse haften wir nur im Rahmen der vom jeweiligen Erzeuger selbst geleisteten
Gewhr. Darber hinausgehend ist jede Haftung, einschlielich solcher fr Schadenersatz, soweit sie nicht
auf Vorsatz oder grober Fahrlssigkeit beruht, ausgeschlossen. Ausgeschlossen ist insbesondere der Ersatz
fr Folgeschden, sonstige mittelbare Schden und Verluste oder entgangenen Gewinn aus mangelhafter,
unterbliebener oder verspteter Lieferung. In jedem Fall ist unsere Haftung mit der Hhe der jeweiligen
Auftragssumme begrenzt.
10. GERICHTSSTAND, ANWENDBARES RECHT, SONSTIGES
Gerichtsstand fr alle sich aus oder im Zusammenhang mit der Geschftsverbindung ergebenden
Streitigkeiten ist ausschlielich Wiener Neustadt. Die Vertrags- und Gerichtssprache ist Deutsch. Wir sind
berechtigt, Klagen gegen den Besteller nach eigenem freiem Ermessen auch am allgemeinen Gerichtstand des
Bestellers anzubringen. Es gilt sterreichisches Recht. Die Anwendung des UN-Kaufrechtes ist ausgeschlossen.
Die Unwirksamkeit einzelner Bestimmungen berhrt die Wirksamkeit der brigen Bestimmungen dieser
Geschfts- und Lieferbedingungen nicht. Aus dem Umstand, dass wir einzelne oder alle der uns hierunter
zustehenden Rechte nicht ausben, kann ein Verzicht auf diese Rechte nicht abgeleitet werden.

4. WARENBERNAHME
Ware, welche offensichtlich auf dem Transportweg mit Feuchtigkeit in Berhrung gekommen ist, ist sofort bei
bernahme auf einwandfreien Zustand zu prfen.
5. WARENLAGERUNG
Die Lagerung unserer Waren muss in trockenen, gut durchlfteten Rumen erfolgen.
6. WARENRCKLIERFERUNG
Gelieferte Waren knnen nur nach vorheriger Genehmigung von uns zurckgenommen werden. Distanzhalter
werden ausschlielich zu vollen Verpackungseinheiten und in einwandfreiem Zustand akzeptiert. Fr
beschichtete Nieten, Schrauben und Profile gilt kein Rckgaberecht. Ebenso bei Sonderstanzungen, Kanten-,
Anschluss-, Abschluss-, Fugen-, Lftungs- und jeglicher Art von Sonderprofilen. Profile, die Spuren von
Weirost, Beschdigungen oder Verschmutzungen aufweisen, knnen in keinem Fall zurckgenommen
werden. Weirost kann entstehen, wenn die Profile mit Feuchtigkeit in Verbindung kommen, zum Beispiel
durch Niederschlag oder Kondenswasserbildung. Mit Kondenswasser (Schwitzwasser) ist vor allem dann
zu rechnen, wenn kaltes Transportgut in warme Rume gebracht wird. Oben angefhrte Hinweise sind
genau zu beachten, anderenfalls knnen keine Gewhrleistungsansprche bercksichtigt werden. Die
Ausstellung der Gutschrift erfolgt nach Eingang und sorgfltiger berprfung der Retourware, abzglich
einer Manipulationsgebhr von 20% des Warenwertes.
7. ZAHLUNGSBEDINGUNGEN
Sofern nichts anderes vereinbart ist, sind unsere Rechnungen binnen 7 Tagen netto ohne Abzug zur
Zahlung fllig. Zur Annahme von Wechsel oder Scheck sind wir nicht verpflichtet und erfolgt immer nur
zahlungshalber. Alle mit der Einlsung verbundenen Kosten gehen zu Lasten des Bestellers. Fr den Fall
des Zahlungsverzuges werden Verzugszinsen in Hhe von 8%-Punkte ber dem von der sterreichischen
Nationalbank verlautbarten Basiszinssatz, mindestens jedoch 10% p.a. vereinbart. Auerdem ist der Besteller
im Falle des Zahlungsverzuges verpflichtet, uns die Kosten der Forderungseintreibung in Hhe der nach dem
Rechtsanwaltstarifgesetz und dem Gerichtsgebhrengesetz dafr vorgesehenen Kosten und Gebhren zu
ersetzen. Der Besteller ist nicht berechtigt Forderungen gegen unsere Kaufpreisforderungen aufzurechnen.
Ebenso ist der Besteller nicht berechtigt, fllige Zahlungen wegen behaupteter Gewhrleistungsansprche
zurckzuhalten. Die Abtretung von Ansprchen gegen uns an Dritte ist dem Besteller nicht gestattet.
8. EIGENTUMSVORBEHALT
Unsere Lieferungen erfolgen immer unter dem ausdrcklichen Vorbehalt unseres Eigentums an der
gelieferten Ware bis zur vollstndigen Bezahlung unserer Kaufpreisforderung. Der Besteller hat die
Vorbehaltsware mit kaufmnnischer Sorgfalt getrennt von anderer Ware zu verwahren und auf seine
Kosten ausreichend gegen alle Risken zu versichern. Der Besteller ist berechtigt, die Vorbehaltsware
im Rahmen seines ordentlichen Geschftsbetriebes weiterzuverarbeiten und/oder zu veruern. Die
Weiterverarbeitung erfolgt fr uns und fhrt nicht zum Verlust unseres Eigentums. Im Falle der Verbindung
oder Vermischung mit nicht in unserem Eigentum stehenden anderen Waren entsteht zu unseren Gunsten
Miteigentum im Verhltnis der Anteile. Bereits jetzt tritt der Besteller alle seine Forderungen, die ihm aus
der Weiterveruerung der Vorbehaltsware gegen Dritte entstehen, ebenso wie alle die Vorbehaltsware
betreffenden Ansprche aus Versicherungsvertrgen, bis zur Hhe unserer Kaufpreisforderung an uns
ab. Der Besteller hat eingehende Gelder aus abgetretenen Ansprchen getrennt von eigenen Geldern zu
verwahren und bei Flligkeit unserer Kaufpreisforderung unverzglich an uns weiterzuleiten. Wir nehmen
diese Abtretung an und verpflichten uns im Gegenzug, abgetretene Ansprche nicht vor Flligkeit unserer
Kaufpreisforderung einzuziehen. Fr den Fall des Zahlungsverzuges verpflichtet sich der Besteller, uns
ber erste Aufforderung die Kufer der Vorbehaltsware ebenso wie seine Versicherer bekannt zu geben. Es
ist dem Besteller untersagt, die Vorbehaltsware oder die an uns abgetretenen Ansprche vor vollstndiger
Bezahlung unserer Kaufpreisforderung zu verpfnden, sicherungsweise zu bereignen oder sonst anders als
hier vereinbart an Dritte zu veruern. Zwangsvollstreckungsmanahmen und andere unsere Rechtsstellung
beeintrchtigende Zugriffe Dritter auf die Vorbehaltsware hat uns der Besteller unverzglich schriftlich
anzuzeigen. Der Besteller hat derartigen Manahmen unter
Hinweis auf unser Vorbehaltseigentum sofort zu widersprechen.
9. GEWHRLEISTUNG UND HAFTUNG
Offene Mngel sind bei sonstigem Ausschluss unverzglich nach Erhalt der Ware, versteckte Mngel
unverzglich nach deren Entdeckung und unter genauer Beschreibung des Mangels schriftlich zu
rgen. Die Gewhrleistungsfrist wird mit sechs Monaten ab dem Tag der Lieferung begrenzt. Zu Recht
erhobene qualitative und quantitative Reklamationen werden von uns entsprechend den bestehenden
kaufmnnischen Usancen und im Einvernehmen mit unseren Kunden geregelt. Schadenersatzansprche
wegen Nichterfllung des Liefervertrages sind jedoch ausgeschlossen. Erfolgt die Lieferung unserer
Produkte mit von EUROFOX erstellten Montageplnen (Montagerichtlinien und technischen Informationen)
sind diese Montageplne (Montagerichtlinien und technische Informationen) unbedingt von Ihnen zu

GENERAL TERMS AND CONDITIONS

We produce and supply our goods and services exclusively on basis of the following terms:
Any deviation is not accepted unless it has been agreed explicitly in written form. Any contrary terms of business by the customer are not allowed, even if orders or documents refer to them, and have not to be contradicted explicitly by us in particular cases.
1. CONTRACTUAL RELATIONSHIP
Any details in offers, price lists, catalogues, advertisements, sales promotions as well as in samples for inspection are always subject to confirmation and without obligation. A contractual relationship will originate only
from our written confirmation of order. Any omission of discussion does not count as an agreement. Any
deviation from the offer in our order confirmation must be the subject of an immediate complaint in writing;
otherwise any legal action is excluded. Exclusively on the basis of previous written agreement, regular customers orders may be confirmed by us orally/by telephone.
2. PRICES
Only the prices specified in our confirmation of the order are effective. Orders made/confirmed orally are
regarded as posted on the day of order, according to the corresponding list price. A cash discount on list prices
is without exception allowed subject on the condition that all the invoices have been paid entirely and in due
time. All quoted prices are net prices (legal sales tax, VAT excluded).
3. SUPPLY
If not agreed otherwise, delivery is accepted ex works. The unloading is always on responsibility and at the
risk of the customer. We are entitled to deliver in parts. We endeavour to meet the delivery date notified by
us but do not guarantee our delivery dates, even if confirmed by us. Any problem with delivery not caused
by us, including any possible delay in delivery by our suppliers, authorise us to extend our delivery time or
to withdraw from the contract. Any claim for compensation by the purchaser because of delayed or omitted
delivery is excluded in any case.
4. RECEITP AN ACCEPTANCE OF GOODS
Goods which obviously have been exposed to dampness on transportation have to be inspected promptly on
receipt for their unobjectionable condition.
5. STORAGE OF GOODS
Our goods and materials have to be stored in dry and well-ventilated premises.
6. RECONSIGNMENT OF GOODS
Delivered goods must not be returned unless otherwise expressly allowed by us in a previous written permission. Brackets are taken back just in entire packing units and unobjectionable condition without except. No
return is permitted for coated rivets, screws, clamps and profiles - as well at edge-, connection-, end-, joint-,
ventilation- and any kind of special profiles. Profiles with traces of white rust, damages or pollution cant be
taken back at all. White rust may occur when profiles are exposed to dampness, as rainfall and condensation.
Condensation will probably arise when cooled goods are taken into warm premises. The above instructions
have to be followed strictly if not no warranty claims are accepted. A credit note will be issued only on receipt
and careful inspection of the returned products, less a handling fee of 20% of the goods value.
7. CONDITIONS OF PAYMENT
If not agreed otherwise, payment is due within 7 days net without cash discount. We are not obliged to accept
a bill or a cheque; payments are effected on receipt on our bank account. Any transfer charges are debited to
customers account. In case of default of payment, interest for delay at the rate of 8 percentage points above
the base interest rate specified by the Austrian National Bank, is agreed. The minimum rate will be 10% per
annum. Furthermore, in case of default of payment, the purchaser is committed to reimburse our expenses for
collection of the debt, according to the fees and expenses, defined by the Austrian Rechtsanwaltstarifgesetz
(Lawyers Pay Act) and the Austrian Gerichtsgebhrengesetz (Court Costs Act). The purchaser is neither entitled to balance his claims with ours, nor to refuse payment because of allege warranty claims. The purchaser
is not allowed to transfer his title to claims towards us to a third party.
8. RESERVATION OF PROPRIETARY RIGHTS
We always supply with the explicit reservation that the delivered goods remain our property, until our invoice
in respect of the purchase price has been paid off in its entirety. Exercising the due diligence of a prudent
businessman the purchaser has to keep goods specified under this condition separated from other goods
and to assure them sufficiently against all risks. The purchaser is allowed to process the goods specified within
the limits of ordinary business and/or to sell them. This further processing shall take place in our interests and
shall not lead to the loss of our property. In case of incorporation or amalgamation with other goods that are
not our property, we shall be credited with co-ownership, proportional to the quota. By accepting the terms
of this contract, the purchaser has transferred to us all of his claims against a third party resulting from the
resale of the goods specified under this condition, as well as all claims resulting from insurance contracts, up
to a maximum of the purchase price as specified in our invoice. The purchaser has to keep incoming money
from the paid, third party invoices separate from his own money, and immediately to pass it on to us, as soon
as our invoice in respect of the purchase price falls due. We consent to this resale and as a concession we commit ourselves not to collect the resulting payments from the third parties until our invoice in respect of the
original purchase price falls due. In case of default of payment the purchaser commits himself, on our first request, to disclose to us the purchasers of the goods specified under this condition as well as their insurers. The
purchaser is prohibited from mortgaging the goods specified under this condition or the claims transferred
to us, from transferring his ownership as security on a debt, or from selling it to a third party, otherwise than
as agreed in this contract, as long as our invoice in respect of the purchase price has not been entirely paid off.
Compulsory possession orders and other attempts to gain access to the goods specified under this condition
by a third party that affect our legal status have immediately to be reported to us in writing. The purchaser has
promptly to object to such measures, in so far as they relate to our conditional property.
9. WARRANTY AND LIABILITY
Complaints about obvious faults must be made in writing immediately upon receipt of the goods; otherwise
any legal action is excluded. The warranty period shall be limited to six months from the date of delivery. Complaints about hidden faults must be made in writing immediately, upon their discovery and must include an
accurate description of the fault. Any claim regarding quantity or quality that is justifiably raised will be settled
consensually between our customers and us, according to existing commercial practice. However, claims for
damages on account of the non-performance of a supply contract are excluded. If our delivered products are
based on installation plans (installation guidelines and technical information) drawn up by EUROFOX, these
installation plans (installation guidelines and technical information) have to be followed strictly. The installation plans (installation guidelines and technical information), created by EUROFOX, have been drawn up on the
basis of data supplied by the customer. EUROFOX will not verify the accuracy of the indicated data. Therefore
we assume no liability for any data supplied by the customer to EUROFOX. In this regard any warranty claims
and claims for damages by the customer are excluded a priori. EUROFOX is not liable for quality defects and
incorrect technical specifications that are the fault of the suppliers of the materials. Neither do we accept any
liability for defects resulting from failure to comply with our installation plans (installation guidelines and
technical information) or with customs and practices, generally accepted the trade. We warrant the quality
of the products on the basis of the specifications and test standards, stated in the product range. There is no
implied warranty of fitness for certain applications. We specifically are not liable for faults arising from modification or wear and tear, for defects in the supporting construction or installation, or for damage brought
about by the incorrect processing (installation) of any item. For items produced externally we are liable only
on the basis of the warranty, guaranteed by the particular producer. Except in cases based on intention or
gross negligence, no further liability, including liability to pay compensation, is accepted. Excluded in particular is any compensation for consequential loss, for other indirect damages, or loss, or loss of profit due to bad
delivery, default of delivery, or delay in delivery. In any case, our liability (regarding the amount due) is limited
to the total value of the particular order.
10. COURT OF JURISDICTION, APPLICABLE LAW, MISCELLANEOUS
Regarding any disputes resulting from or in connection with the business relation, the court of jurisdiction
is Wiener Neustadt exclusively. The language of the contract as well as at court shall be German. We are also
entitled to institute proceedings against the purchaser, in our sole discretion and at our own discretion at the
purchasers place of general jurisdiction. Austrian law shall apply. The application of the UN purchase law is excluded. The fact of single clauses not being operative does not touch on the effectiveness of the other clauses
of these conditions of sale and supply. Should we choose not to exercise any single right, or all the rights to
which we are hereby entitled, this shall not mean a relinquishment of these rights.
